Terms of Use

The agreement between you and Akojo. Please read it before you create an account.

1. About these terms

These Terms of Use (“Terms”) apply to your use of akojo.finance, the Akojo app at app.akojo.finance, and everything they offer (together, “Akojo”). They are an agreement between you and Akojo Digital Systems Limited (“we”, “us”).

2. Who we are, and what Akojo is

We are a company registered in Nigeria under RC 9854069, with our registered office at 18A, Creek Haven Estate, Off Harris Drive, Ikota, Lagos State, Nigeria.

Akojo brings the money you already have in different places into one view. You connect accounts, send us statements, or forward the alerts your bank already emails you, and we show you what you have, what you are spending and what is coming.

It is a view of your money. It is not a bank, it does not hold your money or make payments, and it is not regulated as a financial institution.

3. How you accept these terms

You accept these Terms when you create an account, and we keep a record of the version you accepted and when. If you do not agree, do not create an account. If you only read our website, sections 6.2, 12, 13, 16 and 18 apply to that use.

How we handle your personal data is set out in our Privacy Policy, which is a notice rather than part of this agreement (section 15).

4. Words we use

  1. (a)Account means your Akojo account.
  2. (b)Connected account means a bank or wallet account you link to Akojo through our provider, Mono.
  3. (c)Your content means what you put into Akojo or have sent to it: transactions, statements, forwarded alerts, receipts, documents, things you add by hand, and what you ask the assistant.
  4. (d)Third-party services means services we rely on but do not run, such as banks, Mono, and market data.

5. Who can use Akojo, and how to sign up

5.1. Who can use it

You must be at least 18 and able to enter a contract. Akojo is for your own personal finances. One person, one account.

5.2. Signing up

Give us accurate information when you sign up, and keep your email address up to date so that we can reach you.

5.3. Keeping your account safe

Keep your password and sign-in codes to yourself, and do not share your account. You are responsible for what happens under it unless it was caused by our own failure. If you think someone else has got in, change your password and tell us straight away at security@akojo.finance.

5.4. Akojo is in private beta

Akojo is invite-only and still being built. Features will change, some will be removed, and it will occasionally be unavailable. We are not promising uptime yet.

None of that changes how your money is treated. Your data is handled the same way it will be after launch, we read and never move money, and a feature going away does not mean your records do. If something is wrong, tell us. That is most of what a beta is for.

6. Using Akojo properly

6.1. What you must do

  1. (a)Use Akojo lawfully and only for your own finances.
  2. (b)Connect and send only what is yours or what you are entitled to share.
  3. (c)Tell us promptly if you notice a security problem or misuse of your account.

6.2. What you must not do

  1. (a)Use someone else's bank details, statements, emails or account, or pretend to be someone else.
  2. (b)Use Akojo for fraud, money laundering or anything else unlawful.
  3. (c)Try to get into another person's account or any system behind Akojo, or get around a limit or security measure.
  4. (d)Upload malicious code, or do anything meant to overload or disrupt Akojo.
  5. (e)Copy, reverse engineer or resell Akojo, except where the law allows it.
  6. (f)Scrape Akojo, or use a bot or other automated tool to copy or mine its content.

6.3. If you break these terms

We may restrict or suspend your access as section 11.2 describes, and where the law requires it or a crime is involved, we may report it to the authorities.

7. What you authorise, and what we can never do

7.1. Connecting accounts

When you connect an account, you authorise us, through Mono, to read it: balances, transactions and account details. That authority lasts until you disconnect, which you can do at any time, from Akojo or from your bank. What we have already read stays in your account until you delete it.

7.2. Statements and alerts

By sending us a statement or setting up a forwarding rule, you authorise us to read what arrives and turn it into records in your account. Stopping the rule stops the mail.

7.3. We can read. We can never move money

Akojo has read-only access to every account you connect. There is no mechanism in this product by which we can move, transfer, withdraw or spend your money, and we never ask for the ability to.

If anything claiming to be Akojo asks you to authorise a payment or transfer, it is not us.

7.4. The assistant

The assistant answers from your records and can propose changes to them, such as a budget. It changes nothing until you approve it. It can never touch your money.

8. Do not rely on our figures alone

We show you figures derived from what your bank tells us, through connections, statements and alerts, and from what you enter. Investment and asset values, prices and exchange rates are estimates. We work hard to make them right, and we tell you where a number came from and when it was last true.

Your bank is the authority, not us. Where Akojo and your bank disagree, your bank is correct. Nothing in Akojo, including the assistant, is financial, investment, tax or legal advice. Do not rely on Akojo alone for a decision where being wrong would cost you something.

9. Fees

9.1. Akojo is free during the beta

We do not charge for Akojo during the beta. We may limit how many bank accounts you can connect, and Akojo will show you the limit. Statements and forwarded alerts are not limited.

9.2. If we introduce a paid plan

You will see the price, including any tax, and what you get for it before you pay, and you will only be charged if you choose the plan. We will update these Terms before charging anyone. We cannot take a fee from a connected account, because we cannot move money from one.

You will be able to cancel at any time, and your plan will then run to the end of the period you have paid for. We do not refund the unused part of a period, unless we charged you in error or the law requires it. A failed payment will not take your records away: we will tell you and give you time to fix it, and you can always export your data.

9.3. Other people's charges

Your bank or mobile network may charge you for its own services. Those are between you and them.

9.4. If you dispute a charge

Tell us at hello@akojo.finance. We will look into it and answer you.

10. Services we rely on

Akojo depends on third-party services. We choose them carefully, but we do not control them: a bank may stop sending alerts or change its statements, a connection may fail, and a price feed may be late. When that happens, your figures may be incomplete until it is fixed. We are not responsible for a third party's failure, and your use of its service may be under its own terms. Links from Akojo to other websites are for convenience, and we are not responsible for those websites.

11. Ending it

11.1. You can leave at any time

You can export your data and close your account from Settings whenever you like. Closing it deletes your data straight away, as the Privacy Policy describes, and cannot be undone. For your security, these two actions pause for three days after the email address on an account changes.

11.2. When we may suspend or close an account

We may restrict, suspend or close an account if it is used to break these Terms or the law, if we are required to by law, or if it puts other people or Akojo at risk.

We will not close your account without telling you why, and unless the law or an urgent security risk prevents it, we will warn you first and give you the chance to fix the problem and to export your data. If you think we got it wrong, write to hello@akojo.finance and a person will review it. This holds someone's financial history, and an account disappearing with no reason given is not something we are willing to have the right to do.

11.3. If Akojo closes

If we ever stop offering Akojo, we will give you reasonable notice and time to export your data.

12. Who owns what

12.1. Akojo is ours

The software, design, name, logos and content of Akojo belong to us or our licensors. We give you a personal, non-transferable right to use Akojo under these Terms, which ends if your account does. You may print or save pages of our website for your own reference.

12.2. Your content is yours

You own your content. You allow us to host, copy, read and display it only as far as we need to run Akojo for you, keep it secure and meet the law, and to have our providers do so for us. We do not sell it. That permission ends when you delete the content or close your account.

12.3. What you promise about your content

You have the right to put it into Akojo, and doing so does not break the law or anyone else's rights. We may remove content that breaks these Terms, and if you think we were wrong, tell us and we will review it.

12.4. Your suggestions

If you send us an idea or feedback, we may use it freely, without paying you or owing you anything for it.

13. Our responsibility to you, and its limits

We provide Akojo with reasonable care and skill, as it is and as it is available. To the extent the law allows, we make no other promise about it, including that it will always be available, free of errors or fit for a particular purpose.

To the extent the law allows:

  1. (a)we are not liable for losses that are indirect or that we could not reasonably have foreseen, such as lost profits or lost opportunities;
  2. (b)we are not liable for a decision you made relying on Akojo without checking it against your bank (section 8), or for anything your bank or another third party does; and
  3. (c)our total liability to you for all claims will not be more than the greater of ₦50,000 and the fees you paid us in the 12 months before the claim.

Nothing in these Terms limits liability that the law does not allow us to limit, including for fraud, or takes away your rights under the Federal Competition and Consumer Protection Act 2018 or the Nigeria Data Protection Act 2023.

14. If your actions cause us loss

If your fraud, your unlawful use of Akojo or your use of someone else's account or data causes us a loss, including a claim brought against us by someone else, you agree to cover that loss and our reasonable costs of dealing with it. This does not apply to the extent that we caused the loss.

15. Your personal data

How we handle your personal data is set out in our Privacy Policy. It is a notice rather than part of this agreement, and agreeing to these Terms is not consent to anything in it.

16. Which law applies, and resolving disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, even though some of our providers process data outside Nigeria.

If something goes wrong, please tell us first at hello@akojo.finance, and we will try in good faith to put it right within 30 days. If that does not resolve it, the courts of Nigeria will decide. Nothing here stops you going to the Federal Competition and Consumer Protection Commission or the Nigeria Data Protection Commission at any time.

17. Changes to these terms

When we change these Terms, we publish a new version with a new date at the top of this page. If a change affects what you have agreed to, we will tell you and ask you to agree to it before you carry on using your account. If you do not agree, you can export your data and close your account.

18. How to contact us

Write to hello@akojo.finance about these Terms or anything else. For security problems, write to security@akojo.finance, and for your data, privacy@akojo.finance.
